Terms of Service

Last updated: [DATE — set at launch]

1. The Service

Daybook is business software for contractors: client management, estimates, job scheduling, a field portal for technicians, invoicing, payments, and related tools. These terms govern your use of the Service.

2. Your account

You're responsible for your account credentials and for the people you invite to your business (office staff and technicians). Keep your login safe; two-factor authentication is available and recommended.

3. Trial and billing

New accounts start with a 14-day free trial that doesn't require a credit card. After the trial, continued use requires an active subscription, billed monthly through Stripe. You can cancel anytime; cancellation stops future billing.

4. Your data

The business data you put into Daybook belongs to you. You can export it from settings, and you can delete your account and its data from settings. We process your data only to provide the Service, as described in our Privacy Policy.

5. Payments to you

Customer card payments on your invoices are processed by Stripe. Stripe's own terms and processing fees apply to those transactions. Daybook is not a party to the transaction between you and your customer.

6. Acceptable use

Don't use the Service to break the law, to send spam, to infringe others' rights, or to attempt to access another business's data. We may suspend accounts that do.

7. AI features

Optional AI features (the in-app assistant and the phone receptionist) generate content automatically. Review AI-generated estimates, messages, and summaries before relying on them — you're responsible for what you send to your customers.

8. Availability and changes

We work to keep the Service available and improving, but it's provided "as is" without warranties of uninterrupted operation. We may add, change, or remove features.

9. Limitation of liability

To the maximum extent permitted by law, Daybook's liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

10. Termination

You can stop using the Service and delete your account at any time. We may terminate accounts that violate these terms.

11. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.

12. Changes to these terms

If we make material changes, we'll notify account owners by email and update the date above.
